1. General

Welcome to our online store Leonidas Délices, the commercial name of the private limited liability company Pitchilune having its head office at 1401 Baulers, Rue  Lossignol, 36 and its operating headquarters at 1000 Bruxelles, Rue du Bailli 21-23 and registered with the RPM in Brussels 0701.899.423  (hereafter referred to as the "Site").

The relationship between the Site and its users, if written provision contrary, is set by these General Terms which are considered to have been accepted by the User, even if they may be contrary to its own general or specific conditions. These Terms and Conditions are available in the different languages used on the website.

The General Terms regulate the security and contractual relationship of transactions between the User and Leonidas Delices. When the user visits the Site, he confirms that he has read and accepted the Terms and Conditions. The above is applicable regardless of whether you visit the Site inside or outside Belgium. If you use additional services from this Site, we will provide you with the additional conditions, and these will also be part of the Terms and Conditions.

The current Terms and Conditions can be changed at any time without prior notification. Any purchase after modification includes an acceptance by the customer of the new conditions.

The Terms and Conditions may be supplemented by other conditions, but have to explicitly referred to. In the event of a contradiction, the current General Terms take precedence.

The terms used in these Terms and Conditions were, if necessary, defined in Article 18 of the General Terms.

2. Data accuracy

Product and pricing information, as well as detailed order information that the User finds on the "Order Confirmation" are established and communicated subject to change and correction. Content adaptations are made regularly without you being explicitly notified. Leonidas Délices  tries to provide the best information about the products and to reflect the precise color of the products. However, the weights, sizes and volumes of the products remain approximations and there is no guarantee that each screen will reproduce an identical colour, or that this colour, when the product is received, will not diverge.

Leonidas Délices cannot be held responsible for the use of this Site, including, without restriction, content and any errors.

3. Price

All prices are listed on the site. In case of delivery in the EC, prices are indicated including VAT and excluding shipping costs. In case of delivery outside the C.E., customs fees and taxes are possibles. If the price is incorrect or if the shipping costs are offered incorrectly, you will be informed as soon as possible. In this case, you will be allowed to cancel your order at no cost.

4. Order online

It is possible to order from 18 years of age or older. The ordering process includes:

1. Choose your product and add it to your "basket";
2. Choose a delivery mode;
3. Enter the delivery address;
4. Include the billing address with payment information;
5. You will be asked to accept the Terms and Conditions;
6. You will be offered the opportunity to review the summary of your order.

After you have completed your order, you will receive an email from Leonidas Délices in which the receipt of your order is confirmed. If you pay with a credit card, you will also receive an email with the status of your payment. As soon as the goods are sent, you will also receive an emailnotification. All orders are dependent on possible stock fluctuations. In the event of an unannounced stock outage, we will inform you and reserve you the right to cancel bookings for an order.

5. Payment

The payment terms we accept are listed on the Site. The amount will be charged in the money unit in which you ordered. Ingenico will also send you an update. For our credit card payment terms and security on this subject, see also our Policy of confidentiality.

By derogation from Article 1583 C. Civ., Leonidas Délices remains the owner of the property sold until the day of full payment of the price and any late interest and/or compensation.

6. Sales contract

A "sale" is the online purchase of an item delivered to your home. Payment is made beforehand. The purchase takes place at this time. The order is sent only after receiving payment.

Leonidas Delights reserves the right to refuse orders in the following cases:

• In severe doubts about the client's abuse of rights or bad faith;
• When the stock runs out or an item is unavailable;
• Determining an invalid offer;
• In case of force majeure.

7. Delivery countries and delivery restrictions

We deliver to all countries listed on the order page of this site. Pay attention to the following specifications:

• Postal box addresses and APO military addresses are not accepted.
• Deliveries are from Monday to Friday, with the exception of public holidays.
• The ordered products will be delivered to the UK with the exception of the Isle of Man and the Channel Islands.
• The ordered products will be delivered to mainland France, including Corsica and with the exception of overseas territories.
• The ordered products will be delivered to mainland Spain, including the Balearic Islands and the Canary Islands.
• The ordered products will be delivered to mainland Italy, including Sicily and Sardinia.

8. Deliveries

Products are only delivered to countries where the website authorizes delivery (see item 7 above). Delivery will take place as far as possible within the time that is communicated in the individual order confirmation. A possible delay will not cause compensation. Incorrectly communicated delivery addresses are the User's responsibility and may cause additional costs that will be recovered from the User. The goods are sent from Leonidas Dellices. If your order is not delivered on time you can always contact us on info@leonidas-delices.com with mention of your customer or order number. If, due to exceptional circumstances, we fail to send your order within 30 days of the order confirmation email, you can cancel the order at no cost and the refund will be guaranteed. The shipment is always carried out by a professional courier. You agree that the shipment may be delivered to a person, other than the Applicant, if the applicant is at the address indicated by you. If no one is present during the delivery, you will be asked to set up a new appointment for a second delivery. This can be done over the phone or by a card in the mailbox. 9. Defective product or incorrect delivery

When you rece, you are required to immediately inspect the products. If you feel that the delivery is not in line with demand, you do not sign the delivery voucher and/or clearly report the problem on the courier's voucher. In any case you must inform us of the problem, within 24 hours, with the indication of your order number, via the following address: info@leonidas-delices.com. If the defect is a manufacturing error or if  Leonidas Delices has delivered the wrong products, Leonidas Delights  pays the cost of returning the goods.

10. Absence of the right of retraction

The right of withdrawal is excluded for contracts concluded remotely through the Leonidas Delices website, under Article VI.53 of the Act of 21 December 2013 and Article 47 - 4 6 degrees of the Law of 6 April 2010 relating to market practices and consumer protection.

11. Limitation of liability

Site use: Leonidas Délices is not responsible for disruption of site availability or access, computer-dependent disruptions, viruses or other inconveniences that may arise from site (including, but not limited to, "missed profits").

Legal guarantee: A 2-year legal guarantee is valid for consumers. This guarantee only covers acompliance deprec that exists for the delivery of goods. In this case, the Seller agrees to replace the defective item without cost.

Use of property: Leonidas Délices is not responsible for loss or property damage or any other damage, regardless of the nature, that the User or third party may incur when using the property.

Deliveries and other exclusions: Leonidas Délices cannot be held responsible for any non-compliance with deadlines, as all deadlines are indicative in nature and do not contain a firm obligation in the head of Leonidas Délices, nor for any other damage it could cause through fault or negligence, even in cases of gross misconduct. Any damage or other damage that could not be foreseen by one of the parties at the time of the conclusion of the sale contract is excluded from compensation.

The total liability of Leonidas Délices will not exceed the purchase price of the product in question.

12. Referral to other websites and use of hardware via the Site

Referral to another website via our Site is only for informational purposes. The information on the Site can only be used with the explicit agreement of Leonidas Délices. It is forbidden to edit, reproduce, download, disseminate, sell or exploit and/or commercially share the services, pages of the Site, or computer codes that relate to the Site.All images on this website are owned by Leonidas Délices. Reproduction of images without prior written consent is prohibited.

The information and suggestions that are transmitted to us via the Site can be used without commitment and without compensation by Leonidas Délices.

13. Stopping activities

The cancellation by Leonidas Délices of the sales contract is always possible, without prior warning.

14. Intellectual property rights

Leonidas Délices has developed this site for commercial purposes. All rights, and in particular all intellectual property rights, related to this Site are managed by and are the exclusive property of Leonidas Délices. On the basis of these rights, it is forbidden to modify, copy, disseminate, yield, reproduce, publish any information or material that is on the site and use it in derivative works. This is with the exception of the following: You can download the content and make a copy for purely personal and non-commercial use provided that you use the content of the material, which is the subject of intellectual property rights, in its original state. Copying or backing up any content outside of personal and non-commercial use is not permitted.

All designs, marks, illustrations, images or emblems that appear on our Site or on our products, accessories or packaging, are and remain the exclusive property of Leonidas Délices. Their reproduction, complete or partial, for whatever reason or for any purpose, is strictly prohibited. Similarly, the use of any combination with another design, symbol, emblem or other logo is prohibited.

The technology is managed by Leonidas Délices and remains its exclusive property.

15. Privacy policy

Leonidas Délices recognizes the importance of privacy. You can find our privacy policy by clicking here. These privacy policy conditions apply to all products and services provided by Leonidas Délices. By using this Site, the User implicitly accepts our Privacy Policy. By ordering via the Leonidas Délices Site, the User expressly consents to the processing and use of his personal data for purposes such as the administration of the customer database, order management, deliveries and invoices, credit monitoring, marketing and advertising.  Leonidas Délices will be able to back up the data, but not transfer the data to third parties unrelated to Leonidas Délices.

The User has a right to review and modify all data and has the right to object to their use for direct marketing purposes at no cost. For more information the User is invited to contact the public register maintained by the Commission for the Protection of Privacy in Brussels.

16. Counterfeiting

Leonidas Délices also wants to protect its consumers from the online sale of counterfeit products. For more information,  Leonidas Delights refers  you to the advice of the European Consumer Centres to avoid the purchase of counterfeits. In case of suspicion of counterfeiting, the consumer can always submit a complaint via the point of contact.

17. Definitions

Within these terms and conditions, the following concepts are defined as:

• General Terms of Sale: these conditions and all its annexes or supplements;
• Order: the result of the ordering process as described in Article 4 of the General Terms. After receiving the payment, the Order becomes a Sale;
• Leonidas Delices: Leonidas Delices, commercial name of the private limited liability company Pitchilune with its head office at 1401  Baulers,  Rue Lossignol, 36  and its operating headquarters at  1000 Brussels, Rue du Bailli 21-23  and registered with the RPM in  Brussels under the number  899.423;
• User: a user of this website, especially someone who, by typing the address of that website or following a link, arrives on this website and uses the website for informational purposes or to place an order;
• Ingenico: the payment processing company, Ingenico, a private limited liability company headquartered at The Avenue de Tervuren 270, 1150 Brussels and registered with the RPM in Brussels under the number 0459.360.623;
• Site: gathering of linked pages, grouped on the universal web under the address of Leonidas Délices. The Site's capabilities range from offering statistical information to interactive communication with multimedia applications and purchasing products.
• Sale: The online purchase of an item delivered to your home. Payment is made in advance. The sale takes place at the time of receipt of payment.

18. legislation

Disputes relating to the closure, validity, interpretation or performance of the current contract or general conditions are governed by Belgian law and are part of the competition of the Brussels courts, subject to the consumer's right to bring the matter before the competent judge on the basis of a mandatory legal provision. All parties accept electronic evidence (e.g. e-mails, backups, ...) in their relationships.

Should one of these clauses be declared null and void or not applicable, the remaining clauses remain fully in force and this condition will apply to the extent permitted by law.

According to art. 14.1 of the EU Regulations nr. 524/2013 you can also call on the alternative resolution of online disputes from the European Union. The online dispute resolution platform provides a one-stop shop for EU consumers and merchants to resolve disputes over both domestic and cross-border purchases.

19. Conclusion

This agreement replaces any previous agreement with the User.
